Power of Attorney for India: Notarisation Services in Singapore

To send a power of attorney for India from Singapore, you sign it in person before a Singapore Notary Public, then the Singapore Academy of Law (SAL) adds an Apostille. India's Ministry of External Affairs says apostilled documents need no further attestation. Stamping and any registration then happen in India, and your lawyer in India confirms those steps. We can come to your home.

Property, Bank or Court Matter in India but You Live in Singapore?

You can't fly home every time a signature is needed. A power of attorney (POA) lets a parent, sibling or friend in India act for you, while you stay in Singapore and keep working.

These are the situations we hear about most from NRIs and PRs in Singapore:

  • Selling or buying a flat or land in India, where your attorney must sign the sale deed and appear before the sub-registrar.
  • Letting or managing property, such as collecting rent, paying tax or dealing with the society.
  • Bank and investment matters, such as operating or closing an account, or handling a fixed deposit or locker.
  • Inheritance, such as claiming a share of a parent's property, or signing a release or relinquishment through your attorney.
  • Court or tax cases, where your lawyer needs someone to appear or sign for you.

A typical recent enquiry: a special POA for a property in India, drafted by a lawyer there, needed back in India quickly. The fear is rejection for a wrong name, a missing stamp or the wrong attestation. Here's how to avoid that.

Special or General POA for India: Which Will Indian Offices Expect?

A special power of attorney (SPA) covers one named act or a short list, for example "to sell flat no. X at [address] and sign the sale deed". Sub-registrars, banks and courts often prefer an SPA because the authority is clear and limited.

A general power of attorney (GPA) gives your attorney broad control over your affairs or property. It's convenient but hands over a lot of power.

Either way, ask your lawyer in India to draft it on the format the local sub-registrar, bank or court expects, because rules vary by state. For other destination countries, see all types of power of attorney we notarise.

Signing Your India POA in Singapore, Step by Step

Here is how to send a power of attorney to India from Singapore without leaving your home or office.

  1. 1Get the draft from your lawyer in India. Send us a photo or PDF on WhatsApp. We check that your name matches your passport, your attorney's details are complete, and there's space for the notarial certificate.
  2. 2Book the signing. Our Notary can come to your flat or condo or to your office. Several family members can sign in one visit.
  3. 3Sign in front of the Notary. Bring your original passport. The Notary confirms your identity and that you understand the POA, then issues the notarial certificate.
  4. 4SAL Apostille. We take the POA to the Singapore Academy of Law, which attaches the Apostille over the counter on working days.
  5. 5Courier to India. We send it by tracked courier to your attorney or lawyer, and send you the tracking number on WhatsApp.

What to prepare:

  • the unsigned POA printed as your lawyer instructed (don't sign it before the appointment)
  • your original passport, plus your NRIC, FIN or pass card if the draft mentions it
  • your attorney's full name, address and ID details (for example, Aadhaar or PAN, as your lawyer asks)
  • recent passport photos, if your draft has photo spaces
  • any instructions from your lawyer about witnesses or thumb impressions

Apostille or Embassy Attestation: How India Accepts a Singapore POA

India and Singapore are both parties to the Hague Apostille Convention. India joined in 2005 and Singapore in 2021.

India's Ministry of External Affairs (MEA) issued an Office Memorandum on 18 November 2020 stating that "no further attestation or legalization of an apostilled document should be required in India as India is a member of the Hague Apostille Convention". It also says an apostilled document "should, therefore, be treated as legalized document in India by all concerned".

So the usual route is: Singapore Notary Public → SAL Apostille → courier to India. For more on how SAL works, see how the SAL Apostille is issued.

Two honest caveats:

  • The High Commission of India in Singapore also offers POA attestation (check its current process on hcisingapore.gov.in). A few banks or offices in India still ask for it in practice. If your lawyer or bank insists on it, tell us before you sign.
  • An Apostille confirms the Notary's signature and seal. It does not replace stamp duty or registration in India.

Your lawyer in India confirms which route their sub-registrar, bank or court accepts.

After It Reaches India: What Your Attorney Must Do Next

The Apostille finishes the Singapore side. In India, the POA usually still needs local steps before it can be used. Your lawyer in India confirms stamping and registration for your document.

Stamping. Section 18 of the Indian Stamp Act, 1899 says an instrument executed outside India "may be stamped within three months after it has been first received in India". Stamp duty is set by each state, and several states have their own Stamp Acts, rates and procedures, so the exact rule depends on where the property or matter is. Ask your lawyer when the three months starts for you and how much duty applies. Keep the courier receipt, because it shows when the POA arrived in India.

Registration. Some POAs, especially those used to sell or register property, may need to be registered or presented at the sub-registrar's office. Section 33 of the Registration Act, 1908 recognises a POA from a principal who "does not reside in India" when it is "executed before and authenticated by a Notary Public", or by certain courts, judges, magistrates or Indian consular officers. Whether a particular sub-registrar needs anything more is a matter of local practice. Your lawyer in India will know.

Adjudication. In some states, your lawyer may send the POA to the stamp office (the Collector) to confirm the correct duty. This is also something your lawyer in India handles.

We don't give Indian legal advice. We make sure the Singapore part is done properly and on time.

Photos, ID and Witnesses Your India POA May Need

Indian POA formats often include things that Singapore documents don't. Check your draft for:

  • Photographs. Many drafts have a box for your passport photo, and sometimes your attorney's. Bring recent photos and ask your lawyer where they go.
  • Thumb impressions. Some property formats ask for them. Tell us in advance, and the Notary can witness your thumb impression alongside your signature.
  • Witnesses. Some drafts have spaces for two witnesses. Ask your lawyer whether the witnesses must sign in Singapore at the same time. If so, bring them, each with photo ID.
  • Names. Your name must match your passport exactly. If your Indian records use a different spelling or an initial, your lawyer may also ask for a "one and the same person" declaration.

The statutory fees are fixed by law and the same at every notary in Singapore. You only choose who gives the better service. Extra signers, and a second copy of the POA, add further fees; we list each one in your quote. Indian stamp duty and registration fees are paid in India and aren't included. See the full breakdown of fees.

Time: signing takes under an hour. SAL processes documents over the counter, Monday to Friday, 9:00am to 4:30pm, then courier to India adds a few working days. Your quote gives a realistic date: notarisation plus the SAL Apostille usually takes 1–2 working days before courier.

Questions NRIs Ask About POAs for India

Does a POA for India need an Apostille or embassy attestation?

An Apostille from the Singapore Academy of Law is the normal route. India's Ministry of External Affairs said in November 2020 that apostilled documents should need no further attestation or legalisation in India. The High Commission of India in Singapore also offers POA attestation, and a few offices still ask for it. Your lawyer in India confirms which one they need.

Does the POA need stamping in India?

Usually, yes. Under section 18 of the Indian Stamp Act, a document signed outside India "may be stamped within three months after it has been first received in India". Stamp duty rates and procedures are set by each state and can differ. Your lawyer in India confirms stamping, registration and the amount of duty for your POA.

Can my Indian lawyer's draft be used?

Yes, and it's the best starting point, because your lawyer in India knows what the local sub-registrar, bank or court expects. Send us the draft before you print it. We check that your name matches your passport, the attorney's details are complete and there's space for the notarial certificate, so you don't sign twice.

Do I need photos or witnesses?

It depends on your draft. Many Indian POA formats have a space for your passport photo, and some ask for two witnesses or thumb impressions. Bring recent photos and read your lawyer's instructions. If witnesses must sign in Singapore, bring them along with photo ID. Your lawyer in India confirms what the office will check.

Can you courier it to India?

Yes. After SAL attaches the Apostille, we courier the original POA to your attorney or lawyer anywhere in India with tracking, and send you the tracking number on WhatsApp. Keep the delivery receipt, because the three-month stamping window under the central Indian Stamp Act runs from when the POA is first received in India.

Can you come to my home to sign?

Yes. Our Notary Public can come to your HDB flat, condo, landed home or office anywhere in Singapore. You sign in person with your original passport, and several family members can sign in the same visit. Video or remote signing isn't available, because Singapore notaries must see you sign in person. The visit fee is quoted upfront.

Can a Singapore notary notarize a POA for someone living in India?

No. The person giving the power must sign in front of our Notary Public in Singapore. If the donor is in India, they sign there under Indian rules. We only provide notary services in Singapore, for people who are here when they sign.

If your POA is only one of the documents you need signed, see how signature witnessing works for declarations and other papers.
